    Asset Acceptance LLC suing me in a state I moved from
    I defaulted with Dell back in April of 2003. Dell financial doesn't even show on my credit report anymore.Apparently Asset acceptance LLC (Anthony J Steele) bought the debt and is suing me. I recently moved from FL to NC last month. I now found out through an informational advertisement lawyer that a claim has been put into the Hillsborough County Circuit Court. Sure enough I searched the counties website and there was a filing put in against me on 10/9/07. There is a summons issued apparently and set for 12/2007 at 10am. It shows it was returned/not served on 11/5/07. My questions are?

    1. Do I have to travel 625miles to appear in court

    2. Am I now cover under NC laws?If so what are limits on this kind of debt?The debt is 3 years 8months old.

    3. Would this debt have expired by now? Date of last payment was 03/2004 with a balance of $1471. Asset Acceptance is on my credit score for $2491. They upped it $1000 dollars
    And shows opened 2/07.

    First a debt NEVER expires. If you borrow money with a promise to repay it then that promise lasts as long as you did. I don't know where people get the idea that their requirement to pay ever expires.

    Its also possible for a debt to double and triple due to interest and legal fees.

    If you do not respond to the summons then a default judgement will be handed down against you. They can then use that summons to garnish your salary or attach your bank accounts.

    If you can afford a lump sum I would contact them and offer a settlement of $1000, see if they bite.
