    My husband wants to adopt my son but
    I don't really know how that works. My son is 6 months old, and his father left the day after I found out I was pregnant. His name is not on the birth certifercate and I have never received anything from him but maybe a phone call a couple times. I have tried to take him to court but he's nowhere to be found. Please help me out? Thank You

    You need advice on how to find him or how can your husband adopt your son?

    To find him hire a PI they are pretty good at locating people. As for the adoption, the father needs to give up his parental rights which I think is going your biggest problem. He has not been doing the right thing before why will he start now.

    Get in contact with a lawyer.

    You need to contact a lawyer. If you think the biological father will consent to the adoption, the lawyer will send him papers and ask him to sign, notarize and return. Then the adoption will proceed from there. If he doesn't agree to sign them, then it's to court you go. Was you married to your husband when you had the child? If so, in some states he is the legal father of the child.

    The courts will want you to make a good faith effort to find the biological father. This is usually done by simply placing an ad in local newspapers (the courts will tell you which newpapers and how long to place the ad)... the ad will announce your intent to have your child adopted. The bio father is then given "x" amount of time to respond to the ad and either agree, or contest the adoption. If in "x" amount of time the bio father doesn't respond you can go ahead with the adoption :)

    Since your husband wants to adopt your son, file a motion in Family Court and continue to make efforts to find the father and document those efforts. You'll need to demonstrate to the judge that you've made a good faith attempt to locate him but to no avail.

    I was told that if you say you don't know who the birth father is even if you do that it would be easier for the adoption to take place. I was told that if you claim not to know who the birth father is the will put an add the paper and if no one comes forward it gives you the green light to finish the adoption

    If you know who the father is... but claim you don't, and an adoption takes place... that is FRAUD!
