Background:

I just purchased some property in NC with which to build a home upon.
The piece of property used to be in two deeds as there were two occupants, A and B.
The properties were merged together into one deed when the previous occupant A decided to give his part to his neighbor B.
I bought the merged parts. At no time was a title check done until I started plans to build a new home on the property.

Now I find out there is a lien placed on it by a company in Texas probably 10 years ago because the previous occupant A had purchased a vehicle and failed to pay it off invoking a reposession. The company hasn't done anything yet so I'm wondering if there is some weird law in NC preventing them. It's really confusing so my question is:
THE QUESTION:

The old occupant is long gone and now am I stuck with his problems? What should I do?:mad:

Go figure the land was just given to the neighbor, he must've known something was up. First I would find out how much the lien on the property is for, hopefully it's not unbearable. Unfortunately for you you can't even go back to the owners title insurance policy to see if they possibly missed it and go after them because they didn't do a search either. You definitely need to get with an attorney and find out what the company with the lien will settle for or if possibly the company will detach the lien from the property and attach it to the prior owners name. I'm in FL. So some laws will be different. A lot of states only use attorneys and don't have Title Insurance Companies.

You should take a look at how Texas handles the Statute of limitations in your case. It May have expired but I don't know Texas law.
