    Relinquishing rights and child support
    My husband had a child with another woman. This woman had three other men tested and never thought my husband was the father, until all the other men tested were determined not to be the father. My husband never knew about this child and has never even seen the child. The woman gets assistance from the Illinois Department of Human Services for medical coverage. She and my husband agree that it is best that he not see or be a part of the child's life. At the last hearing, it was determined that my husband could not give up his parental rights, as she left her fiancé and he would no longer be adopting the child. They did not set any child support as she did not want it and she was not receiving cash assistance from the state. Recently, my husband received a notice to appear at an administrative conference, in November, about child support as the state of Illinois believes that he should pay. Can they still establish that the old support order stands, as she does not want support? Also, if she now receives cash assistance from the state because she is expecting a child with her ex-fiance, can they force my husband to pay child support because her current situation changed her need? Any advice would be greatly appreciated!

    They don't have to even worry about any old support order, they can issue a new order to repay the state for the welfare the baby has received.

    You can not give up any rights that will stop you from owing this. Esp the back money owed to the state for the welfare.

    Also unless there is a new partner to adopt the child, even giving up rights does not stop child support.

    Yes they can force him to pay child support
