    What happens if something happens to spouse
    We just bought a new home and my name is not on loan or deed. What will happen if spouse dies does the bank get the house?

    Without a will, his next of kin get's it.

    The house goes into the Estate of the deceased and ownership is passed to their heirs under a will or under the intestate laws of your area.

    So I would make sure a will is made or the spouse is added to the deed as joint tenant with right of survivorship.
