    I have a question!

Why was there no lease? That is very dangerous.

It takes the same amount of time to evict a tenant with no lease as it takes to evict a tenant with a written lease. It can be anywhere from 2 weeks to 3 months. It depends on the reason for eviction and the backlog in your local court.

If you are evicting the tenant for non-payment of rent then you have to give them a 3, 5, 7 or 10 day written notice telling them to pay or vacate. The time depends on your state law. If they haven't paid or left at the end of that time then you have to file a lawsuit for eviction.

If you are ending their tenancy then you have to give them at least 30 days notice. Some states require 60 days notice. If they haven't left after that time then you have to file a lawsuit for eviction.

At the top of the Real Estate Law forum is a sticky post with links to the landlord/tenant laws for all of the states.
