    judgment in the us and relocating to canada
    :confused:
    I have a judgment from a collection agency in New York city. I made payment arrangements with them and have been paying x amount of dollars :confused. I will be relocating to canada within the year and wanted to know... if I stop paying this monthly amount and move to canada... can the judgment follow me to canada and if so... can they garnish my wages in canada

    There are two ways that a judgment can follow a debtor who relocates to another jurisdiction.

    1. The judgment may be transferred from the original court system to the next provided that the two jurisdictions have an agreement in place for the reciprocal enforcement of judgments. Ontario, for example, has such an agreement with New York.

    2. If no such agreement exists the creditor may commence a new action in the new jurisdiction using the previous judgment as the basis for the claim. Provided the new court recognizes the laws and justice system of the originating jurisdiction as being fair and comparable to its own then the new lawsuit would inevitably succeed.

    In both cases, once the judgment manifests itself in the new jurisdiction the creditor is free to exercise any and all enforcement methods permitted by the local court.

    With all that being said, the creditor would need to find you and determine if it is cost-effective to continue its collection efforts in a foreign jurisdiction.
