    Need a bit more information...

Are you meaning common law divorce? Do you know the whereabouts of your spouse?

My mom has been separated from my dad for over 20 years. They never legally got divorced. She didn't know where he was to file for divorce. All she had to do was file an announcement in newpapers announcing her intent to divorce. My father was given "x" amount of time to respond, when he didn't she was able to go ahead with the divorce on her own.

Please post here to reply to advice instead of PM's... that way when others read, they can get all the information and may be able to give some advice as well.

So you don't know where he is... how long has it been since you have been separated?

By placing an ad in newpapers announcing your intent to divorce... just because he doesn't respond doesn't mean you are automatically divorced. It just means you can go ahead with the divorce proceeding in court without him appearing. And yes, if he doesn't appear, and you have placed the ad and attempted to locate him, your divorce will be granted.

From what Macksmom said I gather you are trying to get a divorce because of abandonment. IN that case the newspaper ad is only one piece. You have to file a petition ofr Divorce with Family Court on the grounds of abandonment. As part of that petition you have to show what efforts you have made to find and contact him.
