    Breaking a lease
    My husband and I are separating and I want to move into one of our rental properties. This property will be deeded to me when we divorce. Right now there we have a tenent and his lease runs out in March 2008. Can I break this lease before March? I would like to move in by November 1st. The tenent is in good standing.

    You can approach the tenant and see if he's open to moving. I'd be willing to make him a monetary offer of some type to persuade him.

    Otherwise, if he wants to finish out his lease, no, you can't break it. As long as he's following the terms of the lease I know of no way to legally break the lease early.

    Actually you may have a case here. Some areas do allow the landlord to terminate the lease early if they plan on using the property for their personal use. So you need to check the laws in your area to see if this applies.

    I would still be inclined to offer the tenant a buyout or at least moving expenses and time to find a new place. Why should they suffer?
