    Breaking lease w/notice
    I am presently moving out of my leased condo. My husband and I gave our appropriate notice though our lease is up October 31, we will be out as of August 31. The question I have is this, I know that they must make a valid effort to re-lease the property and I must keep paying the rent till the end of the period. Is this still in effect if the landlord decides to advertise the rental at a higher rate in which we were paying for the same unit. I was told that if this happens that it cancels the lease agreement out all together. Is this correct or am I still responisbile until they find another tenant or the lease is up, anything would be helpful at any point.

    Yes, they can advertise it at the current rate for rental property, even if that is more than you were paying.

    So yes you have to continue to pay unless the property is rented out.

    If they are advertising at a rate that is above market, then they may be deemed to not be making a good faith effort to re-rent. But they can advertise at a higher rate as long as its within market.
