    Negotiating Rent Payment before Court Date
    Hi -

    I am late on my rent and was served a court notice today that I have to appear on September 9th. I have my own business and so there are times when my cash flow is not consistent. The apartment building I live in is owned by a big management firm and they don't seem to care or want to work with me. I tried to pay most of my rent ($1,000 of the $1,300 due) but they said it had to be all or nothing. Now they are just adding more fees as the time goes by.

    I am trying to collect my rent and next month's rent this week so I can pay them and get back on track but am being told by the building manager (not the corporate people) that I have to pay it today to hold off the eviction.

    Is there any way to work with them at this point or am I at a total loss?

    I am scared and at a loss on what to do.

    Check your state laws. In most places, if you pay any arrears plus fees on or prior to the court date that will stave off eviction. If you go into the eviction hearing with the money and tell the judge you have tried to work out payment, I doubt if they will be granted eviction. However, if you are chronically late, they may get it.

    Thank you! I think I may just found a way to pay it by tomorrow which I hope helps avoid the court appearance all together. If I pay my September rent on time I hope to work my way back into their good graces but realize thanks to your answer that the law can easily sway their way more than I realized. Thanks again for your input!

    Hello tc:

    In some states, your landlord is required to accept FULL payment for the rent prior to your going to court. They are NOT required to accept partial payment. You can see your state law at the top of this forum on a sticky note.
