False Rental Advertising & Maintenance issues
I moved into a basement apartment in May of 2007. In the advertisement it states that the carpet is new, the bathroom is newly renovated and it also says if you sign a year lease you get a free Sega Dreamcast with 2 Controllers and 20 games. It is now August 3rd and I have never received the Sega Dreamcast. Also I wasn't going to make a big deal out of everything because the girl I am renting from, her mother is Ill so I wasn't going to put up a big stink about it. My bank recently froze my account due to Identity Theft. She is now threatening me to evict me because I told her I was going to be late for a couple of days with my rent. I get locked in my bathroom because the door handle is falling off, I have cockroaches coming out of every crack in the house, all the windows are sealed shut with being painted over 15 hundred times, there is no smoke detector in case of a fire, the carpet in certain spot is really stained. I have even got locked out in the early morning because my key wouldn't work. Oh and in the kitchen, the light switch cover is missing I took pictures just in case. What I want to know is do I have any legal standing if I want to get out of this years lease if I wanted to, I think I should considering they promised something in the advertisement and to me that is false advertisement to have you ad answered. Could someone help me

    Hello cow:

I don't think you can get out of your lease. False advertising isn't an issue, bucause you had a chance to look for yourself. If the bath wasn't renovated like there said it was and you moved in anyway, that's on YOU.

Do your communication in writing with the landlord from now on. If you have a list of work, send them a certified letter about it. Pay your rent as soon as you can. If you're late for even one day, they can evict you.
