You and boyfriend will need to consult an attorney. Normally the natural father will always need to give written consent no matter how much or how far he is deliquent in child support, maybe even if he was or still in on drugs. If it can be proven he is not fit to have custody or or to have visitation rights, it might be possible to have his rights to these privileges taken away but this doesn't seem to an issue. Another issue is that in some states there is common law marriage and then again some states do not recognize common law marriage. You said the prospective adoptive father was your"boyfriend". I doubt (and I don't know what the law is in your state and even if I did I would not have the expertise of an attorney who practices in your state) but my best "guess" is that most courts will not allow a "boyfriend" to adopt. You really need the advice of an attonrey.
