    Relinquishing parental rights for adoption
    Hi,
We got divorced 4 years ago and I always paid child support on time. My ex got remarried and I got laid off from work after a few months later... I couldn't find a job and decided to go school instead of wasting time. In the best interest of our child I, my ex and her new husband agreed to allow my ex's new husband to adopt our child. So we executed an out of court agreement under which:

    1. My ex received 100% parental custody
    2. I was relieved of paying any further child support
    3. My ex husband were to adopt our child at an appropriate time

The agreement was singed by all 3 parties in the presence of Notary Publics.

Does this agreement hold any water in the court of law? They haven't yet filed for adoption.

    Thanks in advance and regards.

I can understand why this is important to you and I can only assume you now wish to void or modify the agreement. I would think that you sought legal advice before signing the agreement due to it's importance but if you did not, right now is a good time. I don't know the answer but I would guess the agreement is binding (in a court of law) but it's best to ask an attorney, one that you pay for his/her services, not just free advice from one. I would want my attorney (and yours) to think long and hard and have something to lose if /e/ she gives me an incorrect answer that's why I do not care for free advice especially when it's an important matter.
