    My EX is given his visatation rights away is that posabale
    Hi I am new to this site

    I have a 18 month old child. Who's father wants nothing to do with the child. I filed papers for custody and child support. He has responded to the summons. He said that he is not close to the child and he dose not want to deal with me and wants to devote his time to work and his other 4 children. Well he dose not give much attention to his first born child he hardly sees her and she is 14 now I just want to know will this stop him from paying support he has not paid a dime to help pay rent food or child care witch she gose to the same daycare a his 3 other children and the lady that picks my baby up from daycare lives in the same apt complex as him so He can see our child when every he desired but chose not to I wa very close to the other kids too.

    So my question really is can he avoid paying for support by stating that he is not close to the child and wants to chang the last name to mine not his and be devoted to his work and his 4 other children.

    Not a chance. Plain and simple. If the court allowed that they would be saying that the state will accept the financial responsibility of being daddy and the state won't do that. He may be able to "give up his rights to the child", in fact if he actually says just that he is not close to the child and he dose not want to deal with you and wants to devote his time to work and his other 4 children the court will probably be happy to say "fine, you have no rights" BUT they will tell him he will still have to pay child support. After all he doesn't have to assert the rights he does have, the Court doesn't really care about that because they know they can't make someone want to be a dad but they do care about his financial responsibility because they can make him pay and they will.

    Thank you I am at a loss to what to think and do. I am also pregnant from him too and I just want to strangle him for this given me 2 kids and wants nothing to do with them is deplorable
