    Judgement lifted Does she get her money back?
    Hello all,

    My mom got a judgement against her for a credit card bill wayyy back in 2000. She was not aware of this judgement as the information was sent to an old address.. I took her to the courts and filed an order to show cause. The judge signed it and she was given a new court date.. Because the judgement was lifted does this mean that her accounts are unfrozen or do we have to wait to the new date and see what the judge decides then??

    Judgment was not lifted, only a new hearing was granted. She needs to file a Motion to Quash the garnishment.

    A motion to quash garnishments? That's what I should ask for in court?

    Yes, but do not be surprised if its not granted. What you might be able to get is an order to prevent the money from being turned over to the creditor until a new hearing is held.
