Custody battle with an inconsistent noncustodial parent
My ex was never consistently their for my son. He didn't even meet him until he was 3 years old. We had no contact with him for the first two years, the next year had some spaced out in consistent phone calls. When he did finally visit my son I had to pay for half of his plane fair and house and feed and drive him during the 4 day visit. It was the only visit they ever had when he went home he didn't call again for almost a year. When he received my petition for child support( which he was always adimitly apposed to and he has never provided) he called us ,I didn't want him to speak to my son but after a lot of prodding we set up an agreement that he would call every Wednesday and build back our trust ( my son was very confused by his inconsistent behavior and cried frequently about his daddy not talking to him) He agreed that if he missed any phone calls without warning or explanation that I would put a stop to the calls. Needless to say he miss four calls in ten seeks and didn't call at all for 3 weeks straight. When he did call again I told him he violated our agreement to which he responded that he "has a life" and he has the right to get busy. I told him not to call again. He left several messages "to his son" about how I was ruining everything and that I am the reason they can talk but not worry he would take mom to court and "put her in her place". If it becomes interesting enough to hold his attention for longer than a minute he just might what do I do I make 10.00 and hour part time Im a full time college student and I have received only one support payment for a wapping 147.00a month. I can't afford a lawyer what can I do to save my child hurt feelings and years of therapy if he takes me to court?

For starters he will have to file in California because that is the residential state of the minor and California will have jurisdiction. Chances of him filing in California are slim, he will have to higher a lawyer here and appear here, that will cost him a fortune.

Keep us updated and if he actually does file I can give you some more specific info regarding what will happen and what you will need to do.
