    It would be helpful to have more information from you as far as the type of business you have and where you live.

    I have a number of private businesses. The only people that I need to make sure that know my correct business names are the people at the insurance companies where I am insured. My businesses are in the service industry. I am entirely self-employed.

    Knowing the type of business you have and where you are located will make a difference as to the answers you will receive.

    I'm apologize for taking so long to get back to you. You may have already found an answer to your question.

    In South Dakota, a sole proprietor or general partnership using a fictitious business name must register the name with the Register of Deeds in the county where the business is conducted.

    Where you live, that would be the following place, if the information that I found is up-to-date.

    Clay County Register of Deeds
    211 W Main St # 202
    Vermilion, SD 57069
    (605) 677-7130

    If you are using your own name, such as "Johnny Mac Novelty and Gift Store." I don't believe you need to register the name of your business. But, I may be incorrect on that point. But, at least we know where you need to go in order to register your name if you do need to do that.
