    To name a business?
    Can someone who wants to open a small business use a name that is used somewhere else in the state? It's not in the same county, it's about 65 miles away? Thanks

    Not if the name is trademarked, not if they already have it as a registered name. Not if they already have the name incorporated and so on.

    So basically no.
