    Foreign Wife and Taxes
    My wife and I were married in Japan this year (April 2007). I am now in the process of getting her immigration started (I-130). At this time she is still a permanent resident of Japan. I am hoping that she will be able to immigrate before the end of the year but I am unsure. IT may not be until the first of 2008.
    I was wondering how this affected my 2007 taxes. She will not live with me this year except for a short visit for 3 months on a visitor’s visa.
    Do I count her on my taxes for the 2007 year?

    You and your wife can file jointly as resident aliens for 2007 if you wish. Her physical location is NOT Relevant to filing in this manner.

    If you go this route, however, she will have to pay U.S. taxes on her Japan-sourced income and then claim a foreign tax credit (Form 1116) on the taxes she pays in Japan.
