    Creditor refused payment
I live on the AR/OK state line, and there are what I call loan shark companies in OK. I am TERRIBLE with my money, so I often need help. Here's what happened to me today. The name of this company is world Acceptance in Arkoma, OK. I have been a 'customer' of theirs for MANY years. I'd say at least 10. (sad, I know) and I always pay off my debt, only to return later, asking again. I secretly hope they will refuse, but of course they never do. Why would they, at the interest they charge?! Sorry, I got carried away...

(I am a single, disabled mother of a disabled child. I am currently enrolled full time in college, and money is tight.)

I went by this morning (2-23-07) to pay a payment on one of my loans. I had the check written for March 4th for my Feb 15th payment and a $20 late charge. She wouldn't take it. She said she wanted next months payment with it, and somehow she figured adding the $20 late charge on again. I told her I had the check written for $120 for the 4th. She refused, so I said OK, and left with my check. When I got home, there was a message from them on my machine as if nothing had happened. I promptly called them back and told them they didn't take the payment, so I paid the water bill and the gas bill, and they were all too happy to take it. We argued, she said I was committing a felony since I didn't have the same collateral I had 10 years or so ago. I told her she refused payment so I didn't owe her anything! She actually had the nerve to ask me would I bring the check back to her tonight! HA!

I have every intention of paying my debt. I'm just tired of their bulling ways when I do get in a crunch. Thank you for reading this, and any info you may be able to give. I have contacted the BBB for a report to fill out, also. Is that the correct path?

    Thank you,

I just read this, -http://www.law.cornell.edu/ucc/3/3-502.html- and now I have a headache. What?! How can anyone understand this document? Does it apply to me, in this instance? I want to copy it, send it with the letter I've already drafted to them, notorized. But, I want to know that this applies to me before I do.

Find a local debt counselling agency on your local area. Check out the phone book or internet. They will help.

    Good luck.

    Thank you for your time.

I did contact a local counseling agency quite a while back. Turns out, they're only there to consolidate your debts and help lower or eliminate the interest and pay them off. I paid off all my debts years ago. Then, when I fell on hard times, I turned to these 'loan sharks'. My problem isn't that I owe huge amounts of money. My problem is mishandling the money that I have. I've never known a poor person to need an accountant, but I sure do!

    Hello Wondering:

You don't need an accountant. You need a 12 step program. Your addiction to payday loan stores is just as bad as if it was heroin. Pay them, and quit - cold turkey.

Thank you, and you are right. I am an addictive personality. It's not payday loans, it's worse. They give you loans, in a way that any legitimate business does... except for the ridiculous interest. My life goes through spurts of being controlled, and out of control. I guess I was wanting someone to tell me that she was out of line. Instead, I get the opposite. I guess I'll continue on my course of trying to achieve better discipline. Who would've thought it, for a Psychology major...

To answer your last part of your post concerning U.C.C. - ARTICLE 3 -§3-502-

It does not apply to your situation. It only applies to refusal to accept payment under the original terms. Since the check you offered was post dated it was not under the terms of the original agrement.
