If there is no damage, yes, they should.

In most places the damage deposit cannot be used to offset unpaid rent.

If it states in the leasing agrement: Damage Deposit $450.00. You will get the full damage deposit of $450.00 once the lease agrement is completed, as long as there is NO damage to the apartment caused by you. (Before the signing of the writing agrement there also was a verbal agrement that the person moving in would be staying for 1 year, or if they get a place with Calgary housing then he would be moving out). The verbal part of the agrement was not added to the writing agrement, it wasn't known until after all was sign. The person is being evicted after 6 months due to breaking 8 rules of the house rules and leasing agrement... Do the person who is being evicted get there damage deposit?. even if they have not fulfilled there part of the verbal agrement of being in the place for 1 year??

I will add the idea world you are suppose to, but Iwill be honest, most landlords will not and you will have to sue for it. In general if you owe them 1000 dollars for rents they are not going to just mail you that deposit money. That is what happens normally happens
