Social Security Disability Garnishment
Can my social security disability benefits be garnished to pay unsecured credit card debt?

They arenot suppose to be able to. If these go directly into a bank, they may freeze that bank account and you will have to prove those funds in the bank are from the disability payments to have that bank account released.

Thanks for the opinions. It has been over two years and they cannot garnish social security wages, that is in the state of Arizona. It may be different in other states.

It is not different in other states. It applies to all states. SSD cannot be garnished.

I got a latter this week and they are going to deduct 20% of my SSDI for a student loan... it will devastate me! I will not be able to live on what's left... right now I take my diabetes and blood pressure medicine on odd days to have enough to make it. I am devastated. I am going to try to get the student loan discharged, but not sure where to start!

Write a letter to the student loan corporation and show them documentation proving you are disabled. Or you if you are seeing a therapist, you might could try to have them send a letter on your behalf telling them that you are disabled.

The government is the only one that can make garnishment on your SSDI. They can only garnish student loans, back taxes and child support. They get back the money they gave to you on those situations. Past due credit card debt can not be garnished. I wish you have luck with this.

Sometimes you can go to the Dept. of human services or you can ask me again and send the message to [email protected]; put the subject line as - NEED HELP FOR DIABETES MEDICATION so that I will know who you are. I know of lots of resources to help people out which is why I have been assigned by "Pathways" to write a book for West Tennessee Healthcare. "theAnswerLady"

Well, I was going to and I will when I get the chance. I first have to find it again amongst my notes. Sorry, I was just so sleepy at that time that it was either lay down or fall down. But I will. At one time, www.merck.com; merck is a big pharmaceutical company; was doing it.

I live in illinios and can not pay for my truck anymore. I am on s.s.d and a disabled veteran. When they get a judgement on me can they put a lien on my property and take it from me

Yes, and yes.
They can file a judgment lien
They can execute upon your non-exempt property as well.
But the first thing they may do, even before suing you, would be to take your truck.
