    She wasn't delayed... She was STUCK. You say nobody was negligent... The thing STOPPED WORKING MID RUN...

    Yes this makes a difference, but again, I think negligence will have to be proven. On the other hand, they may prefer to offer a nominal settlement instead of going to court.
