    Lets cut to the chase here. The law allows retail stores to send a letter imposing such a fine. How enforceable that law is in court is debatable. So you can take your chances on the store going to court over it.

    Your daughter may have tried to mitigate her mistake by not removing the item from the store. If you want to believe she was just following along but had an attack of conscience, that's up to you. You can then deal with your punishment of her accordingly.

    Did you even think that maybe your daughter ditched the lip gloss before she got caught because her friend got caught?

    Keep making excuses for her, I hope it works. Of course the way I see it, the way most parents would see it, is that she's on the wrong path. Instead of steering her to the right path you're helping her along.

    Your daughter is guilty for two reasons
    A. She was an accomplice to the crime of theft
    B. She committed an offense herself by "altering or otherwise depriving the property owner" of the merchandise-which is theft.

    Your lucky she isn't facing criminal charges. Pay the fine, and MONITOR your daughter using a cell phone. If she goes near the mall/store she was caught in discipline her. If she goes back, she can be arrested AND charged by the police for criminal trespassing. They can send you another fine!
