What you seem to have is a lazy prosecutor who doesn't want to get involved in what he probably feels is a domestic dispute. So you go over his head. Bring your case to the District Attorney or Chief Prosecutor. If they don't satisfy, go to the State Attorney General or equivalent. This woman should not be able to get away with breaking the law because of a lazy prosecutor.

Thank you all for the advice and statements. I realize that this is a three year thing that I am hopelessly trying to tell a dozen people about in the shortest space possible. Thank you again for all of your help. If anyone else has any ideas PLEASE let me know...
And if you don't mind can you tell me how do I contact the State Attorney? Because every time I call any state officials they tell me "you need to contact your local office, we can get that number for you if you hold..."

Tell them that you have contacted your local office and they have refused to help you. And you need to escalate the issue.
Or talk to your locak state representative. He should have an office in your area. Go in there (don't call) and tell them you are being abused by the system and need help.

Just wanted to give an update. I stopped in the state attorney general's office and like I figured would happen they said they could not help me. Last week my fiancé had to work 7/12's and I had to take 3 days off from work due to his schedule. It was a blessing in disguise. I took those 3 days and I really reflected on the issue at hand and I have decided to quit being the cat in this game and start being the mouse. I am done pursuing any legal action against my mother it is costing a lot of money and far too much effort. And is stressing me out. I have also decided to quit pursuing trying to get her visitation revoked because I believe she will eventually hang herself all I have to do is sit back and wait for that to happen. So from this point forward I am going to focus all my attention on the BIG picture... my kids. I spent three glorious days with all 3 of my kids from morning till night and it was exhilerating!! I have missed a lot by allowing this to consume my life. My daughter is giving us problems (see unruly 7 yr old question if you have any ideas! ) and I plan on focusing my efforts on healing that aspect of my life even if it is pointless until my mother is out of the picture or dead. SOOO... thank you everyone and I really am glad I found this website and I can't believe how amazing all of you are. I hope we can help each other and others more in the future. Thanks again!!
