    Being suied by capital one
    Received a statement of claims-. Capital One is takeing me to small claims court. I am being suied for $1,76290. I have no property no money Have bee unemployed for over 2 years now - I paid when I was receiving unemployment benefits, but after the benefits ran out it was no way for me to pay.

    Can you clarify the amount for which you are being sued, please? I'm guessing it is $176,290 or $1,762.90.

    I am being suied for one thousand seven hundred sixty two dollars and 90 cent

    The amount doesn't matter except to determine whether this is a Small Claims or superior court case.

    If you have absolutely no means of paying this debt the creditor will get a Judgment against you. That judgment will be good for 10 years, renewable for another 10 - in most cases.

    They will hope that during the next 20 years you'll gather together the money to pay them.

    If you have cash on hand you can offer to settle with them - some creditors are settling (literally) for pennies on the dollar.
