Debts
I just got served myself, so PLEASE if anyone can help that would be great! Looks like I will be filing bankruptcy soon.
Hello, I don't know if anyone can help me here but tonight I was served with for an old credit card of about five years ago. I am not working and can not find work, I am receiving unemployment.
This credit card was back when I had a good job and could afford it. My husband was diagnosed with Hep. C stage 3 liver disease. He lost his job and we survived off credit cards, paying bills. He filed bankruptcy but I can't file for a year and four months, until my old one falls off.
I live in Oklahoma and the debt in from Colorado, it is Washington mutual.
Can someone help me please.
Hello DownUnder, I am in the same pickle. I just got served on an old credit card. I live in Oklahoma and it is out of Colorado. I end up losing everything a couple years ago when my husband was diagnosed with stage 3 liver disease. I don't have any money, I am getting unemployment and my husband was in remission for awhile but is still working.
Any idea what I can do or what they will do to me.
Please help if you can.

Thank you for your response. I live in Oklahoma City right now and the debt is from Colorado about five years ago. The debt is from Washington Mutual of 5 thousand dollars. My husband and I had excellent jobs for 10 years, he became deathly ill and was diagnosed with Stage 3 liver disease. He lost his job and we lived on credit cards just trying to survive until he could get a job. Well the job came too late because we ended up losing the house to foreclosure. I lost my job because I had to quit because the apartment job he job was five hours away.
Everything went into default and my husband filed for bankruptcy. I can not file for bankruptcy until May of 2011 because April of 2011 is when my old one falls off.
I don't want to file bankruptcy but I have no options because the 220 thousand dollars house that was foreclosed on and all the credit cards there were run up. Now with being sued and I have 34 days to write something, I am not sure what to do.
I have 17 months until I can file BK.
Please let me know if you need more information.

My husband did include this debt in his bankruptcy, I have a copy of it.
He did file for disablitity but they are coming after me, so that is why I am upside down on this. I don't know if it is possible to file when I still have 17 months to go. I have to file Chapter 7 because we barely make enough right now to survive and a Chapter 13 is paying back.

Wow, Thank you so much. I will call him right now. And I can do this even though I did not file bankruptcy on it. We where married when he did file. Oh, my goodness this is amazing. Thank you

That was excellent advise but unfortunately it is not going to work for me! :( I did find the credit card paper and my name is on the credit card. My husband was signed on as a user. I called the old attorney who handled my husbands bankruptcy and he told me, that they can still come after me.
Any other idea? If you don't mind. I really wish it would have worked out for me...

I haven't used the credit card in over four years, last payment was around March 2007.
