    Child support
    When I was on public assistance a few years ago they had me going to childsupport trying to get support from my child's father he never showed up and I am no longer on public assistance does the case continue or should I go to family court and petition again?::confused:

    Was there a support order made? If not then you will have to go to court to petition the judge to order support. If there was an order made and the ncp is not paying as ordered to then you would have to go to court to have it enforced. Unless you just don't want the money but then you can't blame the father for not paying.

    An order is probably in effect, check with CSE. Keep in mind that the state will probably keep any money you should have received from him during the time you were on public assistance. Now that you're off public assistance, it should all go to you and the kids.

    If it's a support order obtained by public assistance, support ends when you go off public assistance. It's ordered support from HIM to THEM - you are not a party.

    If it's a Court Order in your favor and someone public assistance took it over, then when you get off public assistance it reverts to you. It's ordered support from HIM to YOU - and they simply stepped in.

    If it's YOUR order you would have had to go to Court and you would have a copy. If it's not Court ordered (or if circumstances have changed, which they appear to have done), you must go to Court and get another (or a first) Order for support.
