    Are oral agreements binding among roommates in Illinois?
    Hello everyone,

    A friend of mine has had many problems with her former roommate. The problem is that her roommate's name was not on the lease or any utilities. As you may have already guessed, the roommate has moved out and still owes for two months rent (half), and also owes $1,500 for the electric and water bills.

    My question is what is the roommate's obligation to my friend? Can this be proven using bank and utility statements in small claims court? Surly, something can be done. There were many oral agreements between the two, all of which were broken by the roommate.

    If there is anything that can be done, I assure you that my friend will not be the last one swindled by this person. She is a thief, and a pathological liar. When she moved out, she stole over $500 worth of clothes and other items from my friend. Yes, she has already filed the police report. This matter is still pending. If anyone can help in any way, it would be greatly appreciated.

    Make sure she takes all the proof she can get to court, no matter how insignificant it may seem. Whatever she can not prove could very easily be denied her.

    Yes, oral agreements are binding if you can prove them. So go to Small Claims Court with the proof and get a Judgment. Then the problem is trying to collect the Judgment from someone who you describe as a thief and pathological liar. But a Small Claims Judgment is the first step.
