    Hi,

    I just want to know if I am eligible for the substantial presence that is can I file as a US resident for tax purpose. Can I file the 1040EZ form?
    I was in the US Aug 2000 - July 2002
    And I came to the US again in Aug 2006 and have been here since on an F1 visa.
    I have to file my tax returns so can I use the 1040EZ form instead of the 1040NR?

    Negative; you have NOT met Substantial Presence, as your F-1 time DOES NOT count.

    File Form 1040NR-EZ.
