    Tax exempt on OPT
    HI,
    I'm an F1 student from India.I'm working full time on my CPT and will be on my OPT from May 2008. I just realized that my employer is deducing SSN and medicare taxes from my paycheck. When I spoke to him saying that I don't have to pay SSN and medicare on my F1 status I came to know that he is not sure what I'm talking about . So I just wanted to know where can I find some information on this issue so that I could take the documentation to him. And my last question is, can I claim for these SSN and medicare taxes that where deduced so far when I file taxes next year ?

    You can find the rules in IRS Publication 519. The form for claiming a refund is Form 843, assuming your employer does not refund the money to you directly. Both of these items are available on Internal Revenue Service. Use the search in upper right hand corner of the home page.

    Everyone on F1/OPT is exempt for 5-years. Exempt means exempt form residency and when you are exempt from residency you don't pay FICA taxes.
