    Getting a police camera tape copy?
    So I was in Indiana with my dad in the car, I was the passenger and a cop pulled us over and gave me a ticket for not wearing a seat belt which I actually was, I had on a black shirt and it was a sports car so the seat belt can't be seen from outside except across the shirt which it blended into. Now the ticket only being $25 isn't the big deal, more the fact I was wearing it that's pissing me off. So I was wondering if it would be possible to get a copy of the police cruzer tape with-out a suprina or whatever it is lawyers do to get it(I'm not paying a lawyer more than my ticket cost... ). I'm hoping that through the back window you can see the seat belt in between the side of the car and the seat stretched out towards my body.

    And for those of you who say pay the 25, if I can't get a copy of the tape I will, because court is 125... but if there is any way I can fight it I will because for once I was actually innocent... (my speeding tickets are another matter :), although 1 speeding ticket in 5 years ain't bad I don't think. )

    I think that any way you would go about it would cost you more than the ticket and be a big hassle. It might not even show or prove anything anyway.
    I would pay it and write on the ticket not guilty. Not that that would do any good :(
    I would have told the cop to come over and double check it.

    Oh the cop saw, he said I put it on as I he pulled us over... false but you know who a judge would believe between cop and citizien.. sigh...

    Yes, I know who judge would believe... However, that's not enough.

    In this country, they still have to PROVE you guilty beyond a reasonable doubt. Believing a cop over a citizen ISN'T beyond a reasonable doubt. If you were wearing one, all he's going to be able to say, is that he didn't SEE you wearing one.

    THAT won't be enough to convict you in a trial before a judge. The cop might not even show up.

    Oh one of those you put it on after the fact.
    I love how any more the word of an authority figure is taken over the word of the accused and yet the authorities are getting caught embezzling and everything else now. Shows how trustworthy they really are.
    I lost my sons to CPS lies because they were the ones that were 'reputable' and I was 'the mentally disturbed mom'. I felt like an ax murdering serial killer was more 'reputable' than the lies they made me out to be.

    You can get the tape but the real question is what if the tape does not show anything and you've just wasted your time? Also you can go through the motions and get the tape but you might not get it in time for court. Try calling the police station and see just what for rigamarole you have to do and what it will cost and how long it will take to get the copy of your being pulled over. Remember you are probably not the only person on that day's tape and someone will have to edit that tape to get to your segment.

    Anyhow. Should be able to get a tape free of charge, I think. You pay taxes for them to operate, to get paid, to have benefits or even to idle without purpose where ever they please. I don't see why it's not mandatory for officers to give copies of police videos to the person. They have no right to hide, charge or discourage the distribution of the videos. If the offense is true and correct as stated there is absolutely no reason they can't give the violator a copy of the tape because the fine is sure to pay for the video and than some. Than again we are dealing with the government. Simply to deliver the tape to say... wal-mart, process, ship or deliver and distribute the video would cost them billions, if not trillions. Can't you see. Your costing the government precious money that they definitely don't throw around like a bag full of kittens they try to desperately dispose of. Its not really about money, it's a human rights issue, they make access to anything that possibly disproves their so called justice simply to gain power over the average person, where as the average person is the thing that empowers them. It is only a matter of time before they over step their bounds and in my opinion that day happened back long before most of us had an existence. "even if an evil man escapes justice because the court system rules in fairness and reason... it is much more important that an innocent man remains innocent because fairness and justice are enforced as they should be. Evil is a thing that knows no end or no beginning and will be stopped on it's own time.

    Get pictures taken of yourself, in the car, with the same lighting, same shirt, etc. at various distances.

    At the trial, ask the cop how close he was when he decided to pull you over. Ask him if he saw you without a belt fastened at that moment. If not, what was his probable cause to pull you over? Get other facts from him, including all aspects of the visibility issues.

    Then show the pictures. Ask the officer how each of your pictures varies from what you saw.

    =Reasonable doubt.
