    What are the rules to felonies?
    Confused: In the state of Kentucky, being a commonwealth state what are the rules in felonies? Is there a 3 strikes your out? What if the felonies were like theft and pv, can you get one expunged after so long?

    I have never heard of any state being 3 strikes except for California.
    Not sure on that though.

    Ky is not a three strikes and you are out, but your prior criminal behavior will have an effect on your sentencing and you can expect longer sentencing and less chance at parole for the more crimes you have committed.

    Also it takes many years 8 to 10 without any additional criminal behavior to even be considered for being explunged. But the bad news, police including the DA can see explunged records, and if that crime is connected to the past crime, they can ask the court to consider itin sentencing.

    IF Kentucky has one, VIOLENCE would be a major element. But, I can't find anything that says they have such a law.

    Certainly the feds have such a law, so if you're convicted in federal court in Kentucky, 3 strikes apply.

    Sure, there's probably a law that allows for expungement of your conviction... Will they grant YOUR expungement?? I don't know.

    But, an expungement only removes the conviction from public view. It does not erase the conviction. So, even if it's expunged, it WILL be used against you as a prior conviction in order to enhance your sentence on any new conviction.
