    Probate finalizing soon
    I have 2 brothers living no mom. My dad passed away leaving no will. Oldest brother took administrator job, for my dads estate. He had a yard sale sold or donated mostly everything in house. Now the house was put on market sold at 325,000.00 oldest brother claims father owed loans on the house. He never gave us exact amount of debt. But claims when this is all through that me and younger brother should walk away with little of 10,000.00 each. Does that sound like it was divided between three siblings. I checked out this free site on the internet called www property shark. Com and it doesn't mention anything about mortgages. It doesn't even have the new buyers name. The recent buyer has my brothers name as new owner, but he claims he has to move out by march 24, 2008. How can I get information regarding debts on house. So far I have gotten nothing and haven't seen a inventory list. Isn't there certain rules the administrator has to comply with, and if not will the Judge recognize this and make it proper for us all

    You can challenge the probate, and you can also demand to see all of the records.

    If your dad had mortages or other debts, your brother has to show proof of those debts to you. If you you need to challenge what is being done in court. I mean if you dad had 270,000 in debts I guess it could be right?? You can also go to the court house ( web sites are never right on deeds, liens and the such) and see what liens your dad had on the property and what liens were paid off.
