    California Writ of Execution (money judgement)
    I owed American Express 8000 and was unable to pay. They sued me and got a Judgment for 11,000 which includes legal fees and interests.

    Yesterday I went to get Gas and my debit card was denied. Called the bamk. My Bamk Account was 10,000 negative after taking the 1700 cash I already had in it. They could not tell me why. Finally after checking they said it was through the legal department with a cour order.

    Today in the mail I recvd from the LA Sherrifs department A Writ of Execution (money Judgement) without the sale of any property. So I assume that it what the bank got as well. They had paid 15 dollars (the attorneys) for it in the court.

    I met with an attorney today whi is talking to the suing attorneys to take the freeze off on the account and get me on a monthly plan to pay the amount in full and keep the 1000 as well.

    I own a home but it has no equity and I lease my car. I am employed but my employer has not rcvd anything. I was just scared that someone can show up to my house and start taking things and the attorney said it does not happen.

    I am stressed and as my attorney is talking to the suiing attornies office I am also talking to a bankruptcy attorney (chapter 13) if the need so arises and they do not accept a short term payment plan.

    What are my risks here in the short term and what does this writ of execution (money judgement) without sale of property mean ?

    Without property means execution on your money such as your bank accounts, wages, or any other form of income that they may be able to locate.

    It is rare that anyone goes after personal property anymore unless you have some yachts or mansions in the Bahamas?

    Let the attorney see what he can work out, but be aware, if you have other bank accounts, those could get hit with a levy as well, and if they know where you are employed, they will probably seek garnishment of your wages as well.

    The person with the superior knowledge and good advice is the Attorney you have already retained - he/she knows your State laws and every detail of the situation and any other advice is merely speculation. Same with the bankruptcy Attorney.

    If you do not trust your Attorney and are posting to double check the information given you... find another Attorney you do trust.
