Levy on my bank account - how do I proceed?
I've read several postings on this site; thank you, they have all been helpful. At least letting me know that when a debt has gone as far as a judgment against me, and a levy on my bank accounts, there's basically nothing I can do to turn that around. That makes sense. No question about me owing the money.

I have called the credit agency that placed the judgment, and have made payment arrangements for the balance due. The first payment is scheduled for next month. With my accounts cleared of any money I had, I drew on an advance from my work. However, I'm not sure what to do with this money! I'm scared to deposit it into my bank account in fear it will taken even though I have made payment arrangements. I'm also afraid to open a new account since I have learned (on this site) that they can find that too.

Where do I go to find out the laws or procedures in a levy? Is it only good for this one time, and then they need to create another judgment? How can I be sure that making payment arrangements (and of course making my payments) is going to be enough to prevent them from doing this again at any time they wish?

First, pay by money order. Do not send cash or personal check. Second, you need to read the writ of attachment. In some cases it has to be refiled meaning its only effective against the balance at the time of service. In other cases it may be in affect until the balance is paid.

If you reach a payment agreement, get it in writing. As long as you faithfully adhere to the agreement, they can't further attach anything. But if you are even a few days late, they can then go back after your assets.

I don't have a copy of the judgment or any related paperwork. Where do I get a copy of that? And I'm assuming I need to call the credit agency again and let them know I would like our payment agreement in writing, correct?

Also, will this incident be reported on my credit record?

If the bank froze your account, they should provide you with a copy of the writ. The writ will tell you the court and case number for the judgement.

And yes, WRITE them requesting the agreement in writing.
