    Apartmen Lease
    I renewed my lease at my apartments in Aug '07. My lease expires July 31, 2008, I want to terminate my lease early and when I went to the office they said that Florida Law is that I have to continue paying rent until my apartment is re-leased or my lease expires whichever is first, my lease that I signed however says I must provide them with 60 days written notice and pay up to a month and a half rent as a cancelation fee... I would like to know which is true and where I can find it and print it out.

    They were correct about the law in Florida. However, if you have a written lease that contains a specific provision about early termination of the lease, then that provision takes precedence over the law. The law only applies if the issue is not addressed in the lease.

    They are correct, Florida law allows them to hold you to your lease, NOW of course if your lease does say that, ( an that is not relating to cancelling the lease at the end of the lease or after you go into a month to month if you don't renew) but if it really says that you can hold them to it,

    So show them a copy of it, But be prepared to fight it in court. So you may want to show your lease to a lawyer first to be sure you are ready for a court fight when they sue you.
