    Naming Child on BC
    I am currently divorcing my husband, and am due with a baby in about a week. I am planning on changing my last name back and am going to name her with my maiden name as well. I am putting him down as the father on the birth certificate but I didn't know if there is anyway he can change her last name to his because of child support and insurance?

    Nope.

    The mother legally names the child, so far as I know.

    I think he can refuse to sign the birth certificate if he doesn't like the name, which could make things interesting for you for child support issues (you'd have to prove paternity if he fought it), but other than that, he's out of luck.

    The mom does the official name. So you can put what ever you want. But as Synnen said he can refuse to sign the birth cirtificate for that reason and getting support will be a challenge and when you go to court to try to get them to order a DNA test that then comes back positive he can argue to have the baby's last name the same as his and in my experience it works.

    Hi,

    You mind want to rethink this decision. I felt the same as you do when I had my son. So I gave him my maiden name. Then I ended up getting married so my last name changed. So he didn't have my name or his dads and I can tell that bothers him sometimes.
