Dependent Filing - Eligibility and NO ITIN.
Hi,
My Mother-in-law was staying with my family here in US for more than six months ( about 190 days ) in 2007. During that period, I was providing the entire support ( food, shelter, medical ) for her. She went back to India in the month of December 2007.
My questions are :
1) How many days should a person (non-resident alien) have stayed in US to claim as a dependent for TaxYear 2007 ?
2) If I can claim her as dependent, I do not have an ITIN for her. Is it possible to get an ITIN for a person who is not currently staying in the country ?

To claim your parents as dependent, it is not required that they live with you. Even if they lived whole of 2007 in India, you can claim them if you meet the requirements.
You may meet the requirements of dependent under "Qualifying Relative," if you provided more than half of their support for 2007 and their income is less than $3,400. But a dependent must be U.S. citizen or resident alien.

Hello,
Following up on the same line. My parents are residing in India. I support them fully, they have an income less than $3400. They do have a ITIN number and had been claimed as dependents in my 2006 return (they were in US for sometime in 2006). So, I wanted to know if I could claim them as dependents for 2007 even though they were not in the US for more than 6 months and did not stay with me?
Would greatly appreciate any feedback.

Thanks for the response MukatA. Is it possible to get an ITIN for my mother in law who is in India now after her vacation to US ? What is the procedure and how many days does it take to get an ITIN ? Should I wait till I get her ITIN to file the taxes and claim her as dependent ?
