    Resident or Non-Resident
    Dear Expert,

    I came to the US in Sept 2002 on the F-1 visa, and graudated from college in May 2006. From June 2006- May 2007 I was on OPT, and swtiched under H1B status in Oct 2007.

    I was wondering, for 2007 was I a tax-resident or Non-resident? I thought I should be a resident, because I was already under F1/OPT for 5 calendar year 2002-2006.

    2007: 1/1-5/31 OPT; 6/1-9/30 NOT IN THE U.S. DUE TO THE GAP; 10/1/2007-12/31 H1B

    Please help me determine my tax status.

    File a nonresident tax return for 2007. For 2008 file as resident.

    Thanks. But I am a little confused, you mean for 2007, I should file as resident or non-resident?
