    1040NR or 1040 ?
    Hi,

    I am residence of India. I am in US from Aug 07 till the date. I am with my 2 yrs kid & wife who is house wife. What form I should use to fill the returns? Is it 1040NR or 1040?

    IMO your stay in US should be more than 183 days a year and if that's true in your case you can go for 1040.

    If you are on a H or L visa, you can file jointly with your wife and you CHOOSE to be treated as resident aliens.

    However, you MUST wait until mid-May 2008 before you can file.
