How do I remove someone from the deed?
I bought some property with my money and with the loan in my name several years ago. I had my sister move in with the idea that she could help me with the mortgage and she could help herself out of wasting money on rent. Our initial plan was to fix up the property and if we decide to sell, I recover the money that was used for a down payment and we split the profit according to a fair calculation based on what we have spent over the years. I added her to the deed so that she would feel like she is a true owner. There have been some nasty developments in our family that have ruined our relationship and I want her to move out. How do I get her out of my house? Is there anything I can do short of going through a nasty legal battle, for which I have zero money? She has also been short on her part of the mortgage for several months now, and I am unable to keep up on the payments. I want her gone before my credit is demolished and my home is foreclosed on. Please give me some avenues to explore!

You are not going to like this, you will have to buy her out, Unless you had some written agreement as to what to do if this happpened, she is as much legal owner as you, and you have to make the payments and keep them current if she will not.
This is something to always think about before you add them. Sorry no easy fix, have to buy her out or get her to sign it over. |

My only suggestion is to offer her a couple hundred dollars to help her find a new place or pay a deposit if she signs off the property deed. She might see it as a way out for her... especially if she is as unhappy as you are. I don't know if she wants money for something like that or not... or if she is happy to keep living with you?? Sounds like there probably isn't much peace at home right now... so it might all depend on her desire to look elsewhere for happiness. If she is happy, I'd be tempted to quit doing my share of chores, paying electric bills, or supplying groceries... or whatever else I was doing to add to her comfort... without anything illegal of course... you don't want to get in trouble...
