    Can I get deductions for my wife and Kid in 2007 ?
    Hi ,

    1. I came to US on 21st Oct 2007 and my wife and kid joined me in Oct 28th 2007

    2. The Marital Status in my W2 is MARRIED and Federal and State Exepetions as 7 each.

    3. Now I find that I will not be able to get the exemptions because I have not stayed long.. and actually have to give back some dollars to federal :(

    4. Is it possible that I get my dependants ITIN and then file jointly sometimes later ? Is there any way to save this tax from being paid ?

    What is your citizenship and your visa status?

    It appears that your claimed 7 exemptions on W4. You should file a new W7 with reduced allowances. You may have to pay a penalty of $500 if both of the following apply.
    *You make statements or claim withholding allowances on your Form W-4 that reduce the amount of tax withheld.
    *You have no reasonable basis for those statements or allowances at the time you prepare your Form W-4.

    HI ,

    I am on H1 and my wife and kid is on H4 . I have mentioned all these in my W4 and hence the fed and state exemption status are 7 each . Is it that since I have stayed less than 183 days , I have to file it as single ?

    If you have already left the U.S. then you must file as a non-resident alien and you CANNOT claim your wife's or child's tax exemption.

    You will file the Form 1040NR as a MARRIED non-resident alien, which means you will use the Married Filing Separately tax table.
