    COURT summons/judgement
    I live in western New York. I received a court summons for an old credit card debit. I tried to make a deal with them but they want it all. I'm due to go to court on the 28th this month. What do I expect? What will happen? I read earlier that I should offer them them money (which they will decline) and get it in writing which will help me in court. The debit is for $3,200. This is my last debit I owe, I paid off the other three. Any advise? Please help.

    Hello tina:

    The fact that you offered to pay less than you owe won't help you in court. It's not a defense. As a matter of fact, offers of settlement aren't evidence and aren't even admissible in court. The court doesn't care that they want ALL their money - nor do they care that you want to pay less.

    I'm curious though, even if the court would consider it, why would that make you look good?

    What the court cares about is whether you owe the money. That's all. If you do, then you'll lose. The other guys will get a judgment and then tromp through your bank accounts taking what they wish, and then they'll garnish your paycheck.

    If you DON'T settle, you'll probably owe twice as much again after they get a judgment. Lawyers aren't free and neither are the courts. You'll be paying for both of them.

    So, maybe you should pony up a few more bucks in your offer.

    Hello Tina,

    Don't worry, excon advice is good, As per my experience, Sure you go to court and be confident, your creditor/plaintiff attorney may contact you and may ask for settlement, settle it what you can afford normally 20 (less or more) bargain it and finalized the payment plan in writing for $3200, Please do not ruin your valueble credit
