Child abandoment
My wife is always planning trips out of town but lies to me that she is taking the kids with her but instead she leaves them over her mother house. When I find out about the my kids and try to go and get them my mother in law will refuse to let me get them.
I was told that in Indiana that if you leave for kids for 72 hours it would consider child abandoment. Is this true? What options do I have if she continue to pull stuff like this.
What rights do I have ask a father... Can I call the police and demand my kids back to me... Can my wife be in trouble for leaving the kids with her mother when we are both married and living in the same house.
I am tried of going through this and would like to know my options...
Thank you,
Concerned father...

I doubt very seriously that you can make a case for abandonment, but there is something going on that you need to find out about, as for whatever reason she doesn't trust you alone with the kids, so there are other issues here, so where is your wife going ,and why would she lie about where the kids are?

It is not an issue about trust but it is silly games she do to try to tick me off. She has been trying to provoke into a fight. You see here in Indiana, if you hit a women. You go to jail and she can put a restraining order against me and that way I am out of the house and she can get me for abandonment. Since I was out of the house for more than 72 hours...
I know what she is trying to do but she is pissed of because she can never provoke me.. So she do little crap like this since I care about my boys and I will never give up my house...
This is the only way she can get the house and the kids... If we go to court of which I plan on doing she knows that the house was loan. And it is impossible for her to take because she can afford it by herself... She works and runs the street while I have them after my job and all night.. Until this whore comes home...
So I want to know what if I am out the home for more than 72 hours I can be charge for abandonment, well what her if she leaves and dump the kids my mother-in-law that covers for her lying daughter.
What do you when you have a women that wants to run the streets all the time. This has been going on for the last two years and I have everything documented..
That's what I am going through with this nut case...

Well you can't consider them "abandoned" since they were left in the care of a relative for a few days. And really, "abandonment" does nothing unless you are trying to terminate a parents rights on the grounds of child abandonment and have the child adopted.
You can however pick up the children from your mother-in-laws house. They are YOUR children. So next time she refuses, I would definitely call the police over to escort the children back into your custody.
Now, to the big elephant in the room... why haven't you filed for divorce?? It's obvious you don't have any kind of functional marriage... which is not good for the children.

You can't be charge with abandonment if your in jail for cleaning her clock, but she can get an order of protection, against you and keep you away. I think a better plan is get free consultation with a lawyer, and get custody of your kids after a divorce. You may have to pay, but it will be well worth it, if she is unfit, and paying YOU child support. In Indiana, leaving a chid in good care is not abandonment, by leaving them with her mother, that's babysitting.

File for divorce and custody before your children hear you call their mother a whore and nut case.
And, no, that's not abandoment.
