    ChildSupport and TPR
I am the non-custodial parent and my daughters mother will not agree with any visitation situation presented to her. My question is if I terminate my parental rights to the child am I still responsible for paying child support. Don't get me wrong I don't mind paying child support but I also want to be able see my daughter. Any help will be greatly appreciated.

Visitation has little or nothing to do with support. If you aren't getting the visitation ordered to you or you need to change what was ordered then go back to court and have it adjusted. If there was nothing ordered then go to court and get it ordered. The CP can not keep you from seeing your child, only you can do that by not fighting for time with your child.

If you terminate your rights all you do is give up any and all say in regards to your child. You will still have to pay support until or if your child is adopted or turns 18.

Vistation and child support are two separate issues... she cannot refuse visitation if you stop paying support, and you can't stop paying support because she refuses visitation.

Do you currently have a visitation order court ordered? If so, you need to file contempt of court charges against her.
If not, you need to get into court and file for visitation.

You cannot terminate your parental rights, unless your ex has a spouse that is willing to adopt the child in your place.

If she does not want to agree with any visitation plan presented to her, she will be FORCED to accept a plan by Court order.

It is not her choice to agree to visitation, the court orders specific days and times for visits and she by law is requried to allow the visits, if you have a visitation agreement in place and she is not following it, take her back to court and try charging her with contemp, at some point the judge will sart charging her money.

And no you can not give up you rights most liekly anyway, but if you did you still have to pay child support

Yes you can terminate your rights even though the ex-spouse does not have someone lined up to be their new daddy. I know this because my son has been through it!

TPR and Adoption by Step-father [ 2 Answers ]

After years of apathy, my son's father has recently agreed to relinquish his parental rights. 6 years ago, we agreed to "Joint Legal Custody" and visitation (which he has seldom exercised).
