    Overpaid Garnishment/Levy
    I had a garnishment/levy placed on my paycheck through the IRS from back taxes my ex wife owed through her business. Because she's not currently employed, the IRS came after me (because we filed a joint tax return). My question is - I overpaid by $793 before they stopped the levy. After contacting the IRS numerous times -- they told me within 6 weeks they'd have a check cut and sent to me; however, 3 months later, I never rec'd the check and was then told it was applied toward the last years taxes. How do I insure I receive the $793 tax credit that they said they applied toward my return? I just had my taxes done, and don't know if this is an automatic thing, or if something else needs to be done? Thanks for any help you can provide!

    You need to file as an INJURED SPOUSE, because, though you filed jointly. You can disavow any responsibility for the taxes your wife owes.
