    Statue of limitations for an appeal?
    Hello,

    Is there a statue of limitations for an appeal? My brother has been in prison a year this month. His appeal was submitted in October 2007 and the lawyers are saying they're still waiting on the court to set a date.

    While I do understand this, waiting on a date could be months, maybe years!

    In the meantime a very popular reporter and news station here in Texas wants to take my brother's story to the air. His attorney is aware of this but won't move on it -- and won't answer our questions as to why!

    We have a website online but didn't want to post it here in case it isn't allowed.

    Any case in appellate court can take months to be heard. There is no set time limit for the appeals court to do this. It being a criminal case could take as long as a year. Usually the courts take about 6 months depending on how backed up they are.

    Your brother's attorney obviously has his reasons and does not need to disclose them to you as you are not his client.

    There IS a time limit in which they have to make their dicisions, but it is rarely adhered to, and there's nothing you can do if they go over. Who are you going to appeal to??

    His attorney works with us, and in my opinion, we have one of the best lawfirms here. I trust them, I was just curious as to why he won't air it.

    You see the problem here is that because we didn't ask questions "last time", his old attorney dubbed him, that's why we had to get this law firm we're working with now - more experienced with integrity and character to handle his case.

    So, I ASK questions.
