    F1 wife, F2-F1 Husband
    Hey there,
    I appreciate your help in answering my question.

    I am an F1 student working as a Grad assistant. My husband who was on F2 in 2006 changed his status to F1 in 2007 but has not earned income and paid tuition and fees till March. From April he started his Grad assistantship too. Now I earned 11,130 and he earned 9015 dollars. Can I claim him as dependent since he was for part of the year? If not can I make two personal exemptions one for myself and another for him? Can my husband do the same thing?

    Finally is it possible for us to get our full taxes back?

    Normally a F1 visa holder files as nonresident and can deduct only personal exemption of $3,400, plus itemized deductions.
    What is your country of citizenship?

    Both of you should file separate returns as nonresidents. Each will get his/her own exemption and standard deduction.

    If any one of you did not have any income during the year, then the person filing the tax return can claim exemption for the spouse.
